Mod9 ASR Engine Evaluation License Agreement Your use of the ASR Engine and related models (collectively, the "Software") constitutes acceptance of this Evaluation License Agreement (the "License") by you or your organization (the "Licensee"). Under the License, Mod9 Technologies ("Mod9") grants to the Licensee the non-exclusive, non-transferrable right to use the Software for evaluation purposes for a period of one hundred and eighty (180) days from the date of installation of the Software for the sole purpose of determining whether the Software meets the Licensee’s business requirements and whether the Licensee desires to obtain a commercial license for continued use of the Software. The License does not allow for general commercial use of the Software by the Licensee, such as deployment in a production environment with end users. Acceptance of the License solely through your use of the Software limits some functionality of the Software. To enable full functionality of the Software, the Licensee must formally accept the License by either: (i) starting the Software with the command-line option "--accept-license=yes"; (ii) or setting the environment variable "ASR_ENGINE_ACCEPT_LICENSE=yes". THE SOFTWARE IS PROVIDED "AS-IS", WITHOUT WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL MOD9 OR ITS LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA OR DATA USE, ARISING FROM THE LICENSE OR USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THESE LIMITATIONS WILL APPLY NOTWITHSTANDING THE FAILURE OF THE ESSENTIAL PURPOSE OF ANY REMEDY. The License is the complete agreement concerning the license granted hereunder and may be amended only in writing executed by the Licensee and Mod9.
